This private learning platform ("Jubima-Platform") is operated by Judith Birke (Platform Operator) at jubima.com/moodle.

1) Scope

These Terms govern access to and use of the Jubima-Platform. By signing in, you agree to these Terms.

2) Accounts and Access

• Accounts are personal. Keep credentials confidential and use strong passwords.
• You are responsible for actions under your account. If you suspect misuse, contact the Platform Operator via the contact page: https://jubima.com/moodle/course/view.php?id=20.

3) Acceptable Use

• Be respectful. Do not post illegal, harmful, defamatory, or discriminatory content.
• Do not attempt to disrupt or bypass security, and do not distribute malware or spam.
• Follow any course-specific rules stated on the Platform.

4) Content and Copyright

• Materials on the Platform are protected by copyright and provided for personal learning and teaching purposes.
• Upload only content for which you hold the necessary rights. By uploading, you grant the Platform Operator a non-exclusive licence to store, display, and use your content for learning and assessment on the Platform.

5) Learning Activities and Assessment

Participation data, submissions, grades, feedback, and activity logs may be visible to authorised teaching/support accounts for teaching, support, quality assurance, and academic-integrity purposes.

6) Privacy

Personal data is processed as described in the Privacy Policy (separate document). The Platform uses essential cookies (e.g., session cookies) for login and security; any optional cookies or external tools are used only as described in the Privacy Policy.

7) Availability and Changes

The Platform Operator aims for high availability but cannot guarantee uninterrupted service. Maintenance and updates may occur. Features may change or be discontinued where reasonably necessary.

For help or issues, use the contact page above. If you cannot access the Platform, you may reach the Platform Operator via Mastodon or LinkedIn (see Section 2). Official notices may be posted on the Platform.

9) Liability

Liability is limited to the extent permitted by applicable law. This does not limit liability for intent or gross negligence.

10) Breach and Enforcement

Access may be restricted or suspended for breaches of these Terms, other policies, or laws. Serious cases may be escalated under applicable regulations.

11) Changes to These Terms

These Terms may be updated. Substantive changes will be announced on the Platform and may require renewed consent.

12) Governing Law and Venue

These Terms are governed by the laws of Switzerland, with venue in Canton Thurgau, Kreuzlingen.

1. Purpose of Processing

We process personal data to operate the platform, provide learning activities and assessments, manage accounts, ensure security and stability, and offer support.

We collect and process the following types of personal data:

• Account and profile data (name, username, roles, enrolments)
• Course activity data (submissions, posts, grades, feedback, attempts, completion)
• Technical logs (timestamps, login IP, browser/device, error logs)
• Communication data (messages and notifications within Moodle)

We process personal data based on our legitimate interests in running a private teaching and learning site and, where applicable, contractual necessity and legal obligations. Swiss law applies primarily; EU GDPR may apply depending on circumstances.

Data is retained only as long as needed for operation, support, and documentation of learning activities. Afterwards it is deleted or anonymised; backups follow rolling retention cycles.

We implement appropriate technical and organisational measures to protect personal data; however, absolute security cannot be guaranteed.

Use is intended for invited users only. If you are a legal guardian and believe a minor's data is processed without consent, contact us via the contact page.
